LICENCE TO USE PROPERTY

In consideration of the mutual benefits and obligations described in this Agreement, the receipt of which and the sufficiency of which are hereby acknowledged, the Host and the Guest hereby agree as follows:

• Subject to the terms of this Agreement, the Host grants the Guest a licence to use the Property, on the terms of this Agreement.

• Nothing in this Agreement prevents the Host from entering the Property at any time.
  

BOOKINGS

• The Booking will be confirmed upon communication from the Host to the Guest that the Booking is accepted.

• The Booking will not be confirmed until the Guest has validly agreed to the terms of this Agreement in the manner prescribed by the Host.

• A 50% holding deposit is required to secure the accommodation.

• $2,000 refundable security deposit payable 30 days prior to arrival.

• Final payment is required and will be processed 30 days prior to check-in.

• Rates vary throughout the year according to  peak, off-peak and shoulder seasons.
  

CHILDREN

• Due to the high standards of this gorgeous home, Children under the age of 14 are not permitted on the Property without the prior written consent of the Host.

• Guests are responsible for the actions of any and all children in their group, and must take all reasonable steps to ensure that the children comply with the Guest's obligations under this Agreement.

NUMBER OF GUESTS

• The maximum number of persons who may occupy the Property is 14.

• No extra guests are allowed in houses above those in the booking.

• All guests planning to have visitors must receive written our approval prior to the visit.

• Strictly no large groups or gatherings in any of the houses, unless approved by Management.

• Any guests found with unapproved visitors will receive an automatic cancellation of their booking with no refund. Cedar Springs reserves the right to immediately request all occupants of the property up to, and including, the guest who has registered for the property to vacate the premises immediately.

• Any external caterers, suppliers, must be pre-approved to enter the property prior to stay and all contact details of such suppliers must be communicated via email to Cedar Springs, quoting your booking details.

NO SMOKING   

• Smoking is strictly prohibited inside the Property.

• If infringed, the guest who made the booking will be charged a cleaning fee of $500 if a smoke smell is present inside the room after departure or if cigarette butts are not in a bin.

NO PETS

• In order to protect our local wildlife, unfortunately we are not pet friendly.

SECURITY BOND

• The Guest must pay a security bond in the amount of $2,000 Australian dollars in full 30 days prior to your stay, which will be held until the termination or expiration of this Agreement.

• In the event that the Guest breaches a term of this Agreement, the Security Bond may be forfeited to the Host. The Host will determine, in the Host's sole discretion, whether or not to return some or all of the Security Bond to the Guest.

• In the event that the Property is damaged, the Host may retain the Security Bond until such time as the damage can be assessed and/or repaired. Once the Host has determined the cost of repairs, any balance Security Bond which is not required to pay for repairs, may be returned to the Guest.

• Nothing in this Agreement prevents the Host from claiming additional compensation (in addition to the amount of the Security Bond) from the Guest in relation to any breach of this Agreement or in relation to any damage to the Property.

• The Guest hereby acknowledges and agrees that the Guest may be liable to the Host for any loss or damage that the Host suffers as a result of the Guest's use of the Property, and that this liability is not limited to the amount of the Security Bond.
  

CHECK-IN & CHECK-OUT

• Guests may check-in to the Property on the Arrival Date from 1pm.

• Guests may check-out on the Departure Date by 2pm.

• In the event that Guests do not vacate the Property by 2pm, the Host may charge a late check-out fee in as prescribed by the Host from time to time.

EXTRA CLEANING/SERVICES

• Extra charges apply for any item on the check-out checklist (provided at checkin) that is not complete upon check-out. The accommodation and yard are to be left in a clean and tidy condition.

• Please ensure all dishes are washed and put back into cupboards and all rubbish is removed and placed into the appropriate rubbish bins. Failure to do so will incur a charge for extra cleaning and/or excessive rubbish removal, which will be deducted from the credit card provided at the time of booking.  Extra cleaning/excessive rubbish removal will be calculated on the number of hours required over and above the normal cleaning time and/or the amount of rubbish that needs to be removed beyond the volume of the allocated bin.

 
AMENITIES

·The following amenities are included your stay:

• Flat and fitted bed sheets, quilt/s, quilt cover/s, pillows, pillow covers and towels.

• Leif Body cleanser, body cream, hand and body cream, shampoo and conditioner; and

• Dishwashing liquid, cutlery and crockery, tea towel/s, tea bags and coffee.

 
WILDLIFE PRESENT

• Due to our rural location there can be snakes spiders, ants, flies, insects and other wildlife present around the accommodation. If you cross paths with a snake, please leave it be, do not disturb it or try to move it along. Cedar Springs will not be held accountable for snake bites and injury.

• As we are a working farm, livestock are present. Please do not enter the paddock our cattle are in at any time.

PARTY RESTRICTIONS

• Like most hotels, AirBnBs and accommodation providers, Cedar Springs has a zero tolerance policy on parties being held on the property. We do not allow large groups, gatherings or parties in any of the houses.

• Any guests found to be having parties will receive an automatic cancellation of their booking with no refund. Cedar Springs reserves the right to immediately request all occupants of the property up to, and including, the guest who has registered for the property to vacate the premises immediately.

 
CAMPING/SLEEP-OUT RESTRICTIONS

• Strictly no camping in tents at Cedar Springs.

• Strictly no sleeping-out in vehicles, camper vans, motorhomes, buses, etc.

FIRES

• Strictly no outside fires unless the fire is in a designated fire-pit at Cedar Springs.

• No fires in Summer months (December, January and February).

• Fires are allowed outside of Summer months pending any restrictions at the time.

• Indoor fireplaces are allowed year-round and must be sufficiently controlled to not constitute a danger.

• Automatic cancellation with no refund will occur if a fire is lit outside of the designated areas or if not approved by management.

 
ROAD SAFETY

• Strictly no off-road driving at Cedar Springs.

• Please drive with caution, as other guests and wildlife are present on the property.

• Automatic cancellation with no refund will occur if guests exceed the speed limit or found driving under the influence.

 
DAMAGES

• All damages, breakages or losses to the accommodation, furniture and furnishings, are to be reported to the property manager immediately.

• Please advise Property Management if you discover damage, breakage or default or you have reason to suspect an item may be missing, otherwise we will consider this to be a responsibility of the current guest and will be charged accordingly.

• All damages or theft will be deducted from bond and in the event that damages or theft exceed $2,000 your on-file credit card will be charged accordingly. Cedar Springs reserves the right to proceed with any charges in addition to the accommodation cost on the presented credit card and/or security bond supplied at the time of booking.

• Damages and losses may include, but are not limited to linen and towel replacements, carpet stains, dirty walls, excessive cleaning, rubbish removal, smell removal, linen damages/stains, use of candles leaving behind wax on furnishings and physical damage(s) to the property and/or its contents. 

 
CANCELLATION BY HOST

In the unlikely event that the Host has to cancel or alter the Booking (for example, due to fire or damage to Property), the Host will:

• advise the Guest at the earliest opportunity about the cancellation or alteration of the Booking; and

• make all reasonable efforts to accommodate the Guest, on terms that are acceptable to the Guest.

• if the Host is unable to accommodate the Guest in accordance with the preceding sub-clause hereof, then the Host will refund to the Guest any money which the Guest has paid to the Host under this Agreement, including any Accommodation Fee, any Deposit, and any Security Bond.

CANCELLATION BY GUEST

• In order to cancel a Booking, the Guest must contact the Host via either cedarspringskiama@gmail.com or Phone: 0413 474 462

• For Bookings which are cancelled within 30 days of the Arrival Date, 50% of the Accommodation Fee will be forfeited.

• No refunds for cancellations due to bushfires, pandemics, air conditions and extreme weather events. When a guest needs to cancel their booking due to a bushfire or extreme weather event that prevents all direct access to the property, a credit for the same number of nights and same property (no monetary value) will be offered. Credits are valid for 12 months and cannot be used for bookings on public holidays and long weekends. 

• Guests who do not show up for their booking will not be entitled to a refund or credit.

KEYS

In the event the guest misplaces the Cedar Springs house keys or security gate buzzer, the guest will be charged $700, deducted from their security deposit

NO NUISANCE

• Guests must not do anything which may be reasonably considered to cause a nuisance or annoyance, whether to the Host or to anybody else. Guests must consider neighbours and any other persons within proximity of the Property and must not create excessive noise, whether by loud music or otherwise.

• In the event that Guests cause an unreasonable nuisance or annoyance, that police are called in relation to a nuisance or annoyance that is caused by the Guests, or complaints are otherwise made about a nuisance or annoyance which is caused by the Guests, the Host reserves the right to immediately terminate this Agreement and upon such termination the Guests will have to vacate the Property immediately. Guests will not be entitled to a refund of any money paid to the Host under this Agreement.
  

PROPERTY USE

The Property may be used for short term residential accommodation, not for parties, gatherings, weddings or other functions.

LIABILITY

• Guests must take all reasonable and necessary steps to safeguard the Guests' personal property.

• The Guests and/or any other occupants or invitees of the Guests use the Property at their own risk.

• Cedar Springs does not accept any liability whatsoever for any injury, damage, loss, delay, additional expenses or inconvenience caused directly or indirectly by any events that are out of or beyond our control. This includes but is not limited to bushfires, pandemics, air conditions and extreme weather events.

• The roads, paddocks and ground at Cedar Spring can be uneven. Cedar Springs does not accept any liability whatsoever for any injury, damage, loss, delay, additional expenses caused by uneven roads and ground.

• Cedar Springs is a large farm property and waste materials may exist on the ground in some areas. Cedar Springs does not accept any liability whatsoever for any injury damage, loss, delay, additional expenses caused by any waste materials on the ground.

• Cedar Springs reserves the right to decline a booking for any reason whatsoever at their absolute sole discretion.

• Without limiting the generality of this clause, Cedar Springs shall in no circumstances be liable for the direct, indirect or consequential Loss or damage arising from this agreement suffered by the guest or any third party for any loss or damage.

• The rights, immunities, defences and limits provided for in these conditions shall apply in any action against Cedar Springs for loss or damage whether the action be found in contract, tort or otherwise notwithstanding any breach of the contract or condition hereof by Cedar Springs.

• If any act or omission by Cedar Springs in connection with or related to the performance of this agreement or any default or breach of this agreement by Cedar Springs causes or contributes to any harm or to any loss, the guest indemnifies Cedar Springs fully in respect of:

  (1)    all damages, loss, liability, costs, charges and expenses suffered or incurred by any party as a result of that act or omission or default;

  (2)   any obligation Cedar Springs to pay damages or satisfy any other liability in consequence of such a claim; and

  (3)   all costs, charges and expenses incurred by Cedar Springs in that respect.

• Any claim by the guest against Cedar Springs must be notified to Cedar Springs within 4 weeks of the last day of the guest booking and adherence at the property after which any Claim made against Cedar Springs will be time-barred and not enforceable.

• The liability of the guest to indemnify Cedar Springs will be reduced proportionally to the extent that an egligent act or omission of Cedar Springs contributed to the loss.

• It is not necessary for Cedar Springs to incur expense or make any payment before enforcing a right of indemnity under this agreement.

• This clause survives termination or expiry of this agreement.

WARRANTY

The Guests hereby warrant that they will compensate the Host for any harm, loss or damage which the Host suffers as a result of the actions of the Guests, or of any invitees of the Guests and/or of any other occupants of the Property. This includes but is not limited to harm, loss or damage to the Property or to the Items, or any lost income which the Host suffers as a result of being unable to provide the Property to subsequent guests.

APPLICABLE LAW / BREACH

This Agreement is subject to the laws of New South Wales (NSW) and each Party submits to the jurisdiction of the courts of NSW.

Any breach or anticipated breach by the Guests of any of the terms of this Agreement will permit the Host to enter the Property, to cancel or alter the Booking and/or to remove the Guests from the Property. In the event that a Booking is cancelled or the Guests are removed from the Property, the Guests will not be entitled to a refund of any money paid under this Agreement.
